Privacy Policy for Neon AI

NewPower Technology ("we", "us", or "our") operates the Neon AI mobile application (the "App"), available on iOS and Android. This page informs you of our policies regarding the collection, use, disclosure, sharing, and retention of personal information when you use our App. The same policy applies on both platforms; where a behavior differs by platform, we call it out explicitly.
1. Information We Collect
1.1 Information You Provide
- Account Information: We receive your account identifier and email address from your chosen authentication provider. On iOS we use Apple Sign In (which supports both real and Apple-private-relay email addresses). On Android we use Google Sign-In (your verified Google account email is shared with us). We do not receive or store your authentication password.
- Photos and Images: Photos you upload to use our AI-powered image processing features (e.g., face swap, style transfer, image-to-video generation). These photos may contain faces; see Section 3 for how we handle them.
- Payment Information: Purchase records for credit packages processed through your platform's billing system — Apple In-App Purchase on iOS, Google Play Billing on Android. We do not store your credit card, payment method, Apple ID password, or Google account password — the platform processes the payment.
- Feedback: Messages and optional screenshots you submit through our in-app feedback form.
1.2 Information Collected Automatically
- Device Information: Device model, operating system version, and a hashed device identifier used for guest account management before you sign in.
- Usage Data: Features used, templates selected, and generation task completion status.
- Log Data: App crash reports and performance analytics to improve our service.
2. How We Use Your Information
We use the collected information for:
- Providing and maintaining our AI image and video generation services
- Processing transactions and managing your credit balance
- Creating and managing your account
- Sending in-app notifications about your generation tasks and account status
- Improving the App and developing new features
- Responding to your feedback and support requests
- Detecting and preventing fraud, abuse, and security incidents
3. AI Processing & Photo Data
This section describes how we handle photos you upload for AI processing, including photos that may contain faces. This is the most sensitive category of data the App handles, and we want to be explicit about it. The behavior described in this section is identical on iOS and Android.
Plain-language summary: When you tap "Generate" on a template or in the Swap feature, your selected photo is uploaded to our servers and forwarded to AI inference services that produce the result. The photo and the result are deleted within 24 hours. We do not use them to train AI models. We do not perform face recognition or build any biometric face template from them.
3.1 What we collect
- The photo you explicitly select from your device's photo library and choose to upload.
- Generation parameters you set (e.g., template ID, style options).
3.2 How we process it
- The photo is uploaded to our backend servers via HTTPS/TLS.
- The backend forwards the photo to our primary AI inference provider, RunPod, Inc. (a US-based third-party AI inference service), and in some cases our own GPU infrastructure, to perform image and video generation.
- RunPod processes the photo only to produce the requested generation result. RunPod does not retain the photo beyond the inference window required to return a result, and is contractually prohibited from using it to train AI models or for any other purpose.
- The generated result is returned to our backend, then to your device.
3.3 Retention
- The uploaded photo and the generated result are automatically deleted from our backend within 24 hours of the generation task completing.
- You may also delete a generation result manually from the in-app Creations list at any time before the 24-hour window elapses.
- If you delete your account (Profile → Delete Account), all photos, results, and associated metadata are deleted immediately.
3.4 What we do NOT do with your photos
- We do not perform face recognition, identification, or matching across users.
- We do not build, store, or sell biometric face templates or face embeddings.
- We do not use your photos to train, fine-tune, or improve AI models — neither our own models nor those of third-party providers.
- We do not share your photos with advertisers, data brokers, or any party other than the AI inference providers described in Section 3.2.
- We do not link your photos to other personal information beyond your account ID for the purpose of delivering the generation result back to you.
3.5 Face Data
The App may process photos that contain facial features as part of its AI effect generation (e.g., hairstyle changes, outfit swaps, artistic style transfers). The following applies specifically to face-related data:
- What we collect: Only the photo you explicitly select and upload. We do not separately extract, derive, or store facial geometry, face embeddings, or biometric face templates from that photo.
- How we use it: Face-containing photos are used solely to generate the visual effect you selected. No secondary use of facial features occurs.
- Third-party sharing: The photo (which may contain a face) is forwarded to RunPod, Inc. (United States) for AI inference only. RunPod does not retain the photo after inference completes and is contractually prohibited from using it for any other purpose, including model training.
- Where it is stored: Temporarily on our HTTPS/TLS-encrypted backend servers and on RunPod's inference infrastructure during processing only. Not stored in any other location.
- Retention: Automatically deleted within 24 hours of generation completing (see Section 3.3). Deleted immediately upon account deletion (Profile → Delete Account).
- No biometric processing: We do not perform facial recognition, identity matching, or build biometric face profiles of any kind. We do not use face data to identify you or any other person.
3.6 Your consent
iOS: The first time you tap "Generate" or upload a photo for AI processing in the App, you will see an in-app "Photo Processing Notice" that identifies RunPod as our AI inference provider and summarizes the points above. You must tap "I Agree & Continue" to proceed. If you decline, no photo is uploaded.
Android: By using the photo upload features in the App, you acknowledge and agree to the photo handling described in this section. We are working to add an equivalent in-app consent screen on Android in a future release.
4. Permissions We Request
- Photo Library / Photos & Media: To select photos for AI image processing. We use the system photo picker on both platforms; we only access photos you explicitly choose, and we do not scan or read your library otherwise.
- Save to Photo Library / Storage: To save generated images and videos you choose to download. On Android, this corresponds to scoped media storage permissions.
- Internet Access: To connect to our servers for AI processing, account sync, and in-app purchases.
5. Data Storage and Security
Your data is stored on secure servers and transmitted using encryption (HTTPS/TLS). We implement industry-standard administrative, technical, and physical safeguards to protect your personal information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
6. Third-Party Services
The App integrates with the following third parties. Each is bound by its own privacy policy and applicable data-processing agreements; we share with them only the data necessary for the service they provide. The applicable providers depend on your platform.
- Apple Sign In (iOS only) — Authenticates your account. Subject to Apple's Privacy Policy.
- Apple In-App Purchase & App Store Server APIs (iOS only) — Processes credit-pack purchases and validates receipts. Subject to Apple's Privacy Policy.
- Google Sign-In (Android only) — Authenticates your account. Subject to Google's Privacy Policy.
- Google Play Billing (Android only) — Processes credit-pack purchases. Subject to Google's Privacy Policy.
- RunPod, Inc. (both platforms) — US-based third-party AI inference service we engage to run image and video generation models. RunPod receives only the photo and generation parameters needed to produce the result; they do not retain the data beyond the inference window and are contractually prohibited from using it for model training or any other purpose. Data is processed in the United States. Subject to RunPod's Privacy Policy.
7. Data Retention
- Uploaded photos and generated results: deleted automatically within 24 hours (see Section 3.3).
- Account information: retained while your account is active. Deleted within 30 days of account deletion (Profile → Delete Account).
- Purchase records: retained for the period required by tax and accounting law in our jurisdiction.
- Feedback messages: retained while needed to address the feedback, then deleted.
- Crash and analytics logs: retained up to 90 days, then deleted or aggregated.
8. Children's Privacy
The App is rated 17+ on iOS and is not intended for children under the age of 13 on either platform. We do not knowingly collect personal information from children under 13. If you believe we have collected such information, please contact us immediately and we will delete it.
9. Your Rights
You have the right to:
- Access the personal data we hold about you
- Request correction or deletion of your data
- Withdraw consent for AI processing (which will prevent further uploads)
- Delete your account and all associated data from within the App (Profile → Delete Account)
- Export your data in a portable format (contact us by email)
10. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last updated" date. For changes that materially affect how we process photos or face data, we will also re-prompt the in-app consent (where applicable).
